Preamble

An Act to consolidate and amend the law relating to oaths and solemn affirmations.

Short Title and Commencement

This Act may be called the Oaths Act, 1873, and shall extend to the whole of Bangladesh.

Definitions

Oath: Any form of attestation by which a person signifies that he is bound in conscience to perform an act faithfully and truthfully.

Solemn Affirmation: A solemn declaration made by persons who conscientiously object to taking an oath.

Main Provisions

Section 1 - Power to Administer Oaths

The following persons may administer oaths: - Judges and Magistrates - Commissioners appointed for taking affidavits - Officers authorized by law to administer oaths

Section 2 - Form of Oath

Every oath shall be administered in such form and manner as the person taking it may declare to be binding on his conscience.

Section 3 - Solemn Affirmation

Any person who objects to taking an oath may, instead of taking an oath, make a solemn affirmation in the prescribed form.

Section 4 - Effect of Oath or Affirmation

A solemn affirmation shall have the same legal effect as an oath.

Section 5 - Penalty for False Statement

Whoever makes a false statement on oath or solemn affirmation shall be liable to prosecution for perjury.

Historical Context

This Act was enacted to standardize the administration of oaths and affirmations in legal proceedings and official matters.

Current Application

This Act continues to govern the administration of oaths in courts, government offices, and other official proceedings in Bangladesh.
